The civil rights cause of action is based upon the "state created danger" theory. To succeed in such a claim, plaintiff must prove that his injury was a "foreseeable and direct" result of the state's "deliberate indifference to", or "reckless or willful disregard of", the harm that could ensue from a dangerous condition which the state itself created.
That's the theory. Plaintiff was able to prove the facts which supported this theory with a legion of damaging documents which were not known by plaintiff to exist until several days into the trial. SEPTA will no doubt be sanctioned by the court for its failure to fully respond to discovery requests.
