Not really a rip off. Look at the origin of Galactus and Silver Surfer:
the standard schoolyard bully and his lackey. The lackey always softens up the new kid, tells him whats coming, etc. Then the bully comes along and followes through. So, he's only a rip off in the sense of following a standard form.
