The United States Bankruptcy Court of the Eastern District of Pennsylvania is considering the implementation of a new filing system wherein Chapter 11 and 13 bankruptcies are filed online, requiring that any and all documents pertaining to each individual case are scanned and submitted via secure website.
My initial reaction was that this is a violation of many petitioners' 14th Amendment Right to Due Process, in that said proposed filing system would hinge upon requisite internet access and expensive equipment with which to prepare documents, and therefore not applied fairly to all who wish to petition the Court.
Granted, it isn’t a 'Roe v. Wade substantive due process'-caliber discussion, but but any thoughts?
