Doesn't make sense to me. If they thought their case wasn't airtight, I'd imagine them being more hard-pressed to stick it to him. As it stands, though, if they try stuff like that, they're just going to look desperate and as if they "have it out for him" or something.
I'd say they're playing it confident that they'll get him on the big charges, so now they're just playing by the letter of the law.
