Miramax BOUGHT 'Clerks'; as such they don't have to pay Kevin for anything else having to do with the sale or rental of the flick. In addition, with the exception of Jay and Silent Bob (which belong to Kevin), Miramax owns the rights to all the characters in 'Clerks'.
