The similarities are too much to just chock it up to coincidence. If he didn't blatantly or knowingly rip off Kev's idea, maybe it happened indirectly: Maybe a Burton fan or friend or relative or other influential person suggested the idea based on the image that THEY saw in the comic.
Either way, I think Kevin does have a case and probably could sue the guy and win. Fuckem, let the jury decide. That being said, I doubt this will ever happen.
Also, whether Kevin was joking or not, Burton's quote was still a shitty, snobby, 'better than thou' thing to say, not to mention untrue.
