No, they really, really aren't.
Both must have on some level been inspired by the monument ending of the original movie.
Besides, the two images, while amusingly similar, are different in content and appearance.

Like I've said, I doubt with the movie in development for so long that this idea hasn't been on the table for the movie since before Burton was involved and before the "Jay & Silent Bob" mini-series came out.
The ending is simply the ending of the original "Monkey Planet" novel with an added – very stupid – twist that plays on the original's famous American monument imagery. The truth is, the ending was depressingly obvious even without Kevin's comic.
The suggestion that it's even likely that they consciously or unconsciously stole it is, I believe, utterly absurd.

I'm positive. Absolutely fucking positive that the Fox could pull up documents including that ending or an ending similar enough to it to demonstrate that it was already something on the table as long as five years before.

Yes, and the best part will be when Kevin loses and has to pay both his own and Fox's legal fees and makes himself look like an ass to most of America over this tiny and basically amusing little coincidence. Oh, my, Kevin, go for it!

Ok, let's just imagine for one goddamn moment the ubelievably unlikely scenario in which the movie makers came up with this idea independently from a minor niche comic book.
Now, imagine you're Tim Burton and someone comes up to you or calls you or whatever and offers up this "threat" to you. What are you going to do? What are you going to say? What do you think Kevin would have said?
If we're going to defend Kevin for his stated opinions, then we can't turn into hypocrites as soon as someone else states an opinion about Kevin.
