Had he killed him(on purpose), it would have been a murder of passion. Why? you ask. Because he didn't know that this guy kidnapped and killed his son. Even when he is told he will kill the guy, he still doesn't believe it. He finds out only moments before meeting him, making it a spur of the moment killing, when he sees the pictures. Yes, he doesn't really kill him but that's because he knew what his future was (killing the guy if that hadn't told him that he would kill him). Kind of hard to wrap your brain around but it does make sense.
