I think what Smalls is trying to say is that a lack of response to a permission request should be taken as a denial of permission. If you were looking to use a single image from a Smith film in a huge book of original material, you might get away with writing a couple of letters, the last one being "lack of response will be taken as tentative permission..."
But that doesn't work when you're basing a play entirely upon someone else's work.
I don't understand why you seem to think that this guy has the RIGHT to use someone else's creation, without having obtained permission (or even, it seems, having tried very conscientiously -- he didn't get anything in writing from ViewAskew or Miramax).
And for all his whining about not having Kevin Smith's personal home phone number, it was pointed out by someone else that he DOES have the lawyer's contact info now and can deal with him. I think this is just a cry for attention from Kevin.
I'm all for people achieving their dreams (although, putting on a CLERKS play is a weird dream in my book) but I'm not for people stealing other people's dreams and then getting miffed when they're called on it.
